Welcome to BirchTor. By accessing or purchasing from our online store (the "Site"), which offers Mice, Controllers, and Headphones, you agree to be bound by the following Terms of Service (the "Terms"). In the event of a pricing error, we reserve the right to cancel any orders placed for that product.

2. Limitation of Liability

To the fullest extent permitted by applicable law, BirchTor, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the purchase of any products, including but not limited to loss of profits, data, or use, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your purchase of products shall not exceed the amount paid by you for the specific product giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

BirchTor is not responsible for any damages resulting from misuse, improper handling, or unauthorized modifications of the products (Mice, Controllers, or Headphones). The products are provided "as is" without any express or implied warranties, except as required by applicable consumer protection laws.

3. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, software, and the overall design, is the property of BirchTor or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written consent.

The BirchTor name, logo, and any product-specific branding are trademarks of BirchTor. Unauthorized use of these trademarks is strictly prohibited. All third-party trademarks mentioned on the Site are the property of their respective owners and are used for identification purposes only.

4. Refund Policy

We strive to ensure your satisfaction with every purchase from BirchTor. If you are not completely satisfied with your Mouse, Controller, or Headphones, you may request a refund or exchange subject to the following conditions:

  • Eligibility: Refund requests must be made within 30 days of the delivery date. Products must be returned in their original condition, including all accessories and packaging, and must show no signs of physical damage, misuse, or wear beyond normal inspection.
  • Process: To initiate a refund, please contact us at [email protected] with your order number and reason for return. We will provide you with a return authorization and instructions. You are responsible for the cost of return shipping unless the product is defective or we made an error.
  • Refund Amount: Once we receive and inspect the returned product, we will process your refund to the original payment method within 7-10 business days. The refund will include the purchase price of the product, excluding original shipping charges. For defective or incorrect items, we will also refund the return shipping costs.
  • Exclusions: Products that have been modified, damaged by accident or misuse, or returned without prior authorization will not be eligible for a refund. BirchTor reserves the right to refuse a refund if the product does not meet the conditions outlined above.

5. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
